Agreement to Terms

These Terms of Service govern any inquiry, booking, or event service arranged through edwitles.com or directly with The Elegant DJ (Ed Witles Entertainment, "we," "us," "our"). By submitting an inquiry or signing a booking agreement with us, you ("client") agree to these terms.

Services

We provide DJ, MC/hosting, uplighting, and related event entertainment services as described on this site and as agreed in your specific booking contract. The details of your event — date, time, venue, scope of services, and fee — will be confirmed in a separate written agreement or invoice, which takes precedence over this general page in the event of a conflict.

Booking & Retainer

A retainer of [XX]% of the total fee is required to reserve your date. Dates are not considered booked or held until the retainer is received. The retainer is [non-refundable / refundable under the following conditions: XX]. The remaining balance is due no later than [XX days] before the event date, unless otherwise agreed in writing.

Payment Methods

Accepted payment methods are [list accepted methods, e.g. check, Zelle, credit card]. Any card processing fees, if applicable, will be disclosed before payment.

Cancellations & Rescheduling

If you need to cancel, please notify us in writing as soon as possible. [Describe refund schedule, e.g. "Cancellations made more than XX days before the event may receive a refund of XX%, less the retainer. Cancellations within XX days of the event are non-refundable."] We will make reasonable efforts to accommodate a single date change, subject to availability, at no additional fee within [XX days] of the original inquiry; rescheduling requests closer to the event may incur a rescheduling fee of [$XX / XX%].

If we are unable to perform due to circumstances within our control, we will provide a full refund or help arrange a suitable replacement where possible.

Client Responsibilities

• Provide accurate event details (date, time, venue, load-in access, timeline, and any special requests) in a timely manner.
• Confirm that the venue provides adequate power, load-in access, and setup space for equipment, or notify us in advance of any limitations.
• Communicate significant timeline changes as early as possible.

Equipment & Safety

All equipment remains the property of The Elegant DJ. Clients and venues agree not to move, tamper with, or unplug equipment without our staff present. We reserve the right to adjust volume or content as reasonably necessary for guest safety, venue policy, or legal compliance.

Liability

To the fullest extent permitted by law, our total liability for any claim arising from our services is limited to the total fees paid for the event in question. We are not responsible for indirect, incidental, or consequential damages, including delays or issues caused by venue conditions, weather, power outages, or other circumstances outside our reasonable control (force majeure).

Force Majeure

Neither party is liable for delay or failure to perform due to causes beyond reasonable control, including natural disasters, extreme weather, government orders, or other emergencies. In such cases, we will work in good faith with the client on rescheduling or an appropriate refund.

Governing Law

These terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Any disputes will be resolved in the appropriate state or federal courts located in Maryland.

Changes to These Terms

We may update these general terms from time to time; the version in effect at the time of your signed booking agreement governs that booking.
